1. Introduction
These terms and conditions (“Terms”) govern the provision of training and workshops (“Services”) by Recovery Vault BV (“we,” “us,” “our”). By enrolling in or participating in our training and workshops, you (“Participant,” “you,” “your”) agree to comply with and be bound by these Terms. If you do not agree to these Terms, you should not enroll in or participate in the Services.
2. Services Description
2.1 Training
Our training services are designed to provide Participants with knowledge and skills related to our managed applications and other offerings.
2.2 Workshops
Our workshops are interactive sessions focused on practical application and problem-solving in areas related to our managed applications and services.
3. Enrollment and Payment
3.1 Registration
To enroll in a training or workshop, you must complete the registration process and provide accurate, current, and complete information.
3.2 Fees
Fees for training and workshops are as specified on our website or in our promotional materials. All fees must be paid in full prior to the commencement of the training or workshop.
3.3 Payment Terms
Payment can be made via the methods specified during registration. If payment is not received by the due date, we reserve the right to cancel your enrollment.
4. Cancellation and Refund Policy
4.1 Participant Cancellation
If you need to cancel your enrollment, you must notify us in writing. The following refund policy applies:
- Cancellations received more than 30 days before the start date will receive a full refund.
- Cancellations received 15-30 days before the start date will receive a 50% refund.
- Cancellations received less than 15 days before the start date are non-refundable.
4.2 Company Cancellation
We reserve the right to cancel or reschedule any training or workshop. If we cancel a session, you will be offered a full refund or the option to attend a rescheduled session.
5. Participant Responsibilities
5.1 Attendance
Participants are expected to attend all scheduled sessions of the training or workshop. No refunds or credits will be provided for missed sessions.
5.2 Conduct
Participants are expected to conduct themselves in a professional and respectful manner. We reserve the right to remove any Participant who is disruptive or fails to comply with these Terms.
6. Intellectual Property
6.1 Course Materials
All materials provided during the training or workshop are the intellectual property of Recovery Vault BV or its licensors. You are granted a limited, non-exclusive license to use these materials for your personal, non-commercial use.
6.2 Restrictions
You may not reproduce, distribute, or create derivative works from any course materials without our prior written consent.
7. Confidentiality
7.1 Confidential Information
During the training or workshop, you may receive confidential information. You agree to maintain the confidentiality of such information and not disclose it to any third party without our prior written consent.
7.2 Use of Confidential Information
Confidential information may only be used for the purpose of participating in the training or workshop.
8. Data Privacy
Your participation in the training or workshop is subject to our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.
9. Disclaimer of Warranties
The training and workshops are provided “as is” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the training or workshops will meet your requirements or that their content will be error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Recovery Vault BV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your participation in or inability to participate in the training or workshop.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from the training or workshop.
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the training or workshop by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content presented during the training or workshop.
11. Indemnification
You agree to indemnify and hold Recovery Vault BV, its affiliates, officers, agents, employees, and partners harmless from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your participation in the training or workshop, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Netherlands to resolve any dispute arising out of these Terms or the training and workshops.
13. Miscellaneous
13.1 Entire Agreement
These Terms constitute the entire agreement between you and Recovery Vault BV regarding your participation in the training and workshops and supersede any prior agreements between you and Recovery Vault BV.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
13.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and Recovery Vault BV’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign these Terms or any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without notice to you.
